Welcome to Esferalma (“the Store”, “we”, “us”). By accessing esferalma.com and/or making a purchase, you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. Eligibility

You must be of legal age to enter into contracts in your jurisdiction. By using this Site, you confirm that you meet this requirement and that all information you provide is true and complete.

You may shop as a guest or create an account. You are responsible for keeping your login credentials confidential and for any activity under your account. Notify us immediately of any unauthorized use.

4. Products & Availability

We offer spiritual wellness and decorative products (e.g., candles, crystals, amulets, tarot decks). We make reasonable efforts to describe and display products accurately, but colors or finishes may vary depending on screen and production batch. Quantities are limited, and products may be discontinued at any time.

5. Prices, Taxes & Changes

All prices are shown in USD unless stated otherwise. Taxes and shipping fees are calculated at checkout. We may update prices and promotions at any time without prior notice (changes do not affect confirmed orders).

6. Orders & Acceptance

Your order is an offer to purchase. The automatic confirmation you receive is not an acceptance. The contract is finalized when we ship the product or send explicit confirmation. We may cancel orders for reasons such as lack of stock, incorrect details, or suspected fraud. If canceled, any charges will be refunded.

7. Payments

  • PayPal: Pay using your PayPal account or accepted cards via PayPal.
  • Manual payments (Zelle / Cash App): You must follow the checkout instructions and include your order number in the payment reference. Orders are not processed until payment is verified.
  • Charges/Refunds: Refunds are issued to the original method when possible. Manual payments may be refunded via PayPal or store credit, depending on the situation.

8. Shipping

We ship within the continental United States (48 states) via USPS/UPS or equivalent. We do not ship to Alaska, Hawaii, or U.S. territories.

  • Processing time: 24–48 business hours after payment confirmation.
  • Standard delivery: Estimated 3–8 business days.
  • Tracking: We will provide a tracking number.
  • Incorrect addresses/returned packages: We can reship for an additional fee or refund minus shipping/handling costs.

9. Returns, Exchanges & Refunds

We accept return requests within 14 days of delivery for unused items in original packaging. Some items are final sale (e.g., opened consumables, custom products, gift cards).

10. Promotions, Coupons & Gift Cards

Promotions may be subject to specific terms (dates, minimums, categories). Coupons are not stackable unless explicitly stated. Gift cards are non-refundable unless required by law.

You agree not to use the Site for:

(b) violating intellectual property rights;

(c) spreading malware/spam;

(d) collecting personal data without consent;

13. Reviews & User Content

By posting reviews or comments, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content for commercial purposes (e.g., on product pages), in accordance with applicable law. Do not post illegal, defamatory, misleading, or infringing content.

14. Third-Party Services

We may link to or integrate third-party services (e.g., payment gateways, logistics, analytics). We are not responsible for the content or practices of these third parties. Please review their terms before using their services.

15. Disclaimers

The Site and its products are provided “as is” and “as available.” To the extent allowed by law, we disclaim all express or implied warranties (including merchantability, fitness for a particular purpose, and non-infringement).

16. Limitation of Liability

To the maximum extent permitted by law, Esferalma and its affiliates are not liable for indirect, incidental, punitive, or consequential damages, or for lost profits/income/data resulting from the use of the Site or products. Our total liability for any claim will not exceed the amount paid for the product in question.

17. Indemnification

You agree to indemnify and hold Esferalma harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, violation of these Terms, or infringement of third-party rights.

18. Force Majeure

We are not liable for failures caused by events beyond our reasonable control (e.g., natural disasters, network outages, strikes, government actions, etc.).

19. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida (USA), without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts of Orange County, Florida, unless otherwise required by law.

20. Modifications

We may update these Terms at any time. The current version will be posted on this page with the “Last Updated” date. Continued use of the Site after changes implies acceptance of the updated Terms.

21. Severability

If any provision is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

22. Termination

We may suspend or terminate your access to the Site for breach of these Terms or for operational/legal reasons. Provisions that should survive (e.g., intellectual property, limitations of liability) will remain in effect.
